Terralyn Usage Policy

This Usage Policy governs how you may use Terralyn's AI-powered sustainability analyst. It is part of, and incorporated into, the Terms of Service ("Terms") between you and Climate Data Inc., doing business as Terralyn ("Terralyn," "we," "us"). Capitalized terms not defined here have the meaning given in the Terms.

We may update this Usage Policy from time to time as AI capabilities, regulations, and misuse patterns evolve. Material changes are notified under Section 8.

1. Purpose and Scope

Terralyn is a chat-based sustainability analyst. You can upload documents and data to your Vault, ask questions, generate analyses, and produce draft reports, models, spreadsheets, and other work product. Terralyn answers from (a) your Customer Data, (b) our curated knowledge base of sustainability standards, frameworks, and emission factor libraries, and (c) licensed third-party sources.

Outputs are drafts and decision-support. They are not audited, assured, or verified information. This Usage Policy exists so that you, your colleagues, your auditors, and regulators can understand the bounds within which Terralyn may be used.

2. Permitted Use

You may use Terralyn to:

  • Prepare, draft, and iterate on sustainability disclosures, reports, and internal memos aligned to recognized frameworks.
  • Calculate and estimate greenhouse gas emissions (Scope 1, 2, and 3), energy, water, waste, and other environmental metrics using our emission factor library and your data.
  • Conduct internal analysis of sustainability-related documents (for example, ESG reports of peer companies, 10-Qs, utility bills, bills of materials, supplier responses, standards, and regulations).
  • Draft sustainability policies, procedures, and responses to ratings-agency questionnaires.
  • Draft answers to assurance requests, customer sustainability questionnaires, and investor inquiries for internal review.
  • Train your team on sustainability topics and AI workflows through Terralyn Academy materials.

Outputs from these activities must be reviewed, validated, and where appropriate corrected by a qualified human before they are relied upon, published, filed, certified, or used as a basis for a decision.

3. Who May Use Terralyn

Terralyn is for business and professional use by individuals 18 or older. One natural person per account. You are responsible for all activity under your account. Do not share credentials. If you use Terralyn on behalf of an organization, you represent that you have authority to do so.

4. Content You May Not Upload

You may not upload to your Vault, or submit as a prompt, any of the following:

  • Personal data you do not have rights to share. This includes employee, customer, or supplier personal data that you are not authorized to process under GDPR, UK GDPR, CCPA/CPRA, or equivalent law.
  • Protected Health Information (PHI) regulated under HIPAA or equivalent law.
  • Payment card data (PCI), government-issued identification numbers, or financial account credentials.
  • Biometric identifiers, precise geolocation data tied to individuals, or other categories of sensitive personal information, unless necessary for a documented sustainability workflow and lawful to process.
  • Attorney-client privileged material that you do not intend to share with a technology vendor, or third-party confidential information that you are contractually or legally prohibited from disclosing to service providers.
  • Classified, export-controlled, or ITAR-regulated material.
  • Content that infringes third-party rights, including copyrighted standards, databases, or reports that you are not licensed to upload (note: our knowledge base already contains licensed standards and factor libraries; you do not need to re-upload them).
  • Malware, exploit code, or files designed to disrupt or compromise systems.
  • Content that sexually exploits minors, non-consensual intimate imagery, or content that promotes violence, terrorism, or hatred.

If you are unsure whether you have the right to upload a document, do not upload it.

5. Uses You May Not Make of the Service

You may not, and may not allow any third party to:

  • Use Terralyn for any unlawful purpose or in violation of applicable law, including the EU AI Act, the Colorado AI Act, TRAIGA, or equivalent.
  • Reverse engineer, decompile, probe, or attempt to extract the underlying models, weights, system prompts, agent instructions, indexing metadata, or knowledge base.
  • Scrape, crawl, spider, or systematically extract Outputs, emission factors, or knowledge base content.
  • Use Outputs or knowledge base content to train, fine-tune, evaluate, or benchmark a competing AI model, a competing emission factor library, or a competing sustainability platform.
  • Resell, sublicense, or redistribute Outputs as a standalone product, data feed, or database.
  • Represent Outputs as audited, assured, verified, or human-authored when disclosure of AI involvement is required by law, professional rule, assurance standard, contract, or customer expectation.
  • Circumvent rate limits, usage limits, authentication, or access controls.
  • Use Terralyn in violation of the acceptable use policies of our AI providers.
  • Impersonate another person or misrepresent your affiliation with any organization.
  • Attempt to inject prompts, jailbreak, or coerce Outputs that violate this Usage Policy or the Terms.

6. High-Stakes Use and the No-Sole-Source Rule

Terralyn is a drafting and analysis tool. It is not a substitute for licensed professional advice, audit, or assurance.

No sole-source decisions. You may not use a Terralyn Output as the sole basis for:

  • A regulatory filing, disclosure, or public statement.
  • An assurance engagement.
  • A public "net zero," "carbon neutral," science-based target, or similar climate-related claim.
  • A representation to investors, lenders, auditors, rating agencies, customers, or other stakeholders.
  • A contractual deliverable.
  • An automated decision that produces a legal or similarly significant effect on a natural person (for example, employment, housing, credit, insurance, healthcare, education, or government benefits).

In each case, a qualified human (a professional licensed, certified, or otherwise competent in the relevant domain and jurisdiction) must review the Output, validate the inputs and methodology, and sign off before reliance. Terralyn does not provide legal, accounting, audit, assurance, tax, or regulatory advice.

Just-in-time acknowledgment. For certain high-stakes actions (for example, exporting a regulatory filing template, generating a finalized disclosure, or producing a board-ready report), Terralyn will display a one-time confirmation reminding you of this Section 6. Your acknowledgment is recorded per action. Acknowledgment does not shift responsibility for review. It confirms that you understand responsibility remains with you.

7. Outputs, Citations, and Disclosure

AI disclosure. Outputs are AI-generated. Where you redistribute, publish, or rely on Outputs, you are responsible for any disclosure of AI involvement required by law (for example, EU AI Act Article 50), professional rule, or contract.

Citations. Terralyn provides citations to knowledge-base sources and user files where applicable. Citations support traceability; they do not constitute assurance that the underlying source is current, complete, or appropriate for your specific scope, boundary, methodology, or jurisdiction. You must verify cited sources before relying on them.

Probabilistic outputs. Outputs are produced by large language models and retrieval. They may contain factual errors, fabricated values, outdated regulatory references, incorrect emission factors, or mismatched methodologies. Review before use.

Consistency is not accuracy. Terralyn may return similar Outputs for similar inputs. Similarity is not a guarantee of correctness.

8. Updates to This Policy

We may update this Usage Policy prospectively as laws, AI capabilities, and misuse patterns evolve. Material changes are notified by email and in-product banner at least 90 days before they take effect, unless a shorter period is required by law or to address a security or legal risk. Continued use after the effective date constitutes acceptance.

9. Enforcement

We may investigate suspected violations. Consequences may include warning, throttling, suspension, termination, forfeiture of fees, deletion of violating content, referral to law enforcement or regulators, and pursuit of legal remedies under the Terms. We may also report activity we are required to report by law.
